DOT Employers and Owner Operators

Random drug testing programs are required for employers regulated by the United Stated Department of Transportation (DOT). If you are an owner operator, you are required to be enrolled into a consortium random drug testing program. Smaller DOT regulated employers may also elect to enroll into a consortium random drug testing program for easy compliance. Larger DOT regulated employers typically request a stand-alone DOT random testing program.

Owner-Operators

For owner-operators two important steps must be taken to comply with the DOT FMCSA regulations for drug and alcohol testing:

  1. A pre-Employment test drug test with a negative result must be completed before operating a DOT covered commercial motor vehicle (CMV).
  2. You must enroll into a random testing consortium. Owner-operators are not permitted to manage random testing themselves.

e7 Healths can assist owner operators in all areas of the United States, for immediate compliance with DOT FMCSA regulations for drug and alcohol testing, call today.

Trucking Companies, Bus Companies, For Hire Carriers and Private Fleets

Both stand-alone random testing pools and consortium random testing pools are available for trucking companies, bus companies, for hire carriers and private fleets. Typically companies with over 20 drivers will elect to have a stand-alone random drug testing program. Compliance is more complicated for companies with more than one driver. e7 Healths can simplify the process and help your company with a program that keeps you in compliance and out of trouble with the DOT so that you avoid fines and penalties.

DOT Compliance

The Vaccine Offers a complete compliance program for companies regulated by the United States Department of Transportation (DOT) and required to be in compliance with DOT drug and alcohol testing regulations 49 CFR Part 40. Our compliance programs include:

  • Designated Employer Representative (DER)
  • Written Policy
  • Regulations on file
  • Pre-employment Testing
  • Random, Post-Accident, Reasonable Suspicion, Return to Duty and Follow-up Testing
  • Employee Education
  • Supervisor Training
  • Previous Employer Checks
  • Removal of employees from safety sensitive positions when positive or refusal to test
  • Substance Abuse Professional

Each DOT Agency and the USCG has regulations that require certain employers to implement a random testing program. Compliance experts at e7 Health can help you navigate through the requirements for your DOT required random drug testing program. The specific DOT agencies requiring DOT drug and alcohol testing programs are:

  • Federal Aviation Admin (FAA)
  • Federal Railroad Admin (FRA)
  • Federal Transit Admin (FTA)
  • Pipeline and Hazardous Materials Safety Administration (PHMSA)
  • United States Coast Guard (USCG)
  • Federal Motor Carrier Safety Admin (FMCSA)

Every company regulated by the above mentioned agencies with DOT covered employees required to be in a drug and alcohol testing program must have on staff a Designated Employer Representative. The Designated Employer Representative, or DER, is an employee authorized to take immediate action to remove employees from (or have them removed from) safety-sensitive duties and to make required decisions in the testing and evaluation processes. The DER also receives test results and other communications for the employer. Only an employee (or the employer directly) may act as a DER. This is one of the only roles that a service agent can never perform.

e7 Health is a Consortium/Third-Party Administrator (C/TPA) - a service agent that provides or coordinates one or more drug and/or alcohol testing services for Department of Transportation (DOT)-regulated employers. As a C/TPAs, e7 Health provides and coordinates the provision of a number of such services. e7 Health performs administrative tasks concerning the operation of employers' drug and alcohol testing programs.
